Section 1 Provider and Scope

(2) These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 BGB) and businesses (§ 14 BGB) via the provider's online shop. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.

Section 2 Ordering Process and Conclusion of Contract
(1) The contract is concluded with Pro Pet Koller GmbH (so).
(2) The products offered in the online shop constitute a binding offer to conclude a corresponding purchase agreement. The customer can place the desired products in the shopping cart and then proceed to checkout. Before submitting their order, all data is displayed on an order summary. Here, the customer can identify and correct any input errors. By clicking the "Place order" button, the customer submits their binding contractual declaration, thereby accepting the offer from the provider. The purchase agreement is thus concluded. Immediately thereafter, the customer receives an order confirmation email, confirming receipt of the order.
(3) The language available for concluding the contract is German.
(4) The contract text is not stored by the provider. However, the customer receives an email with the order details and the General Terms and Conditions. The current General Terms and Conditions can be viewed at any time on the website.

Section 3 Prices, Shipping Costs and Delivery Terms
(1) The prices listed on the website include statutory VAT and other price components. Shipping costs are added separately.
(2) Shipping costs are €5.95. Shipping is free for consumers within Germany for orders over €30. Shipping costs to Austria are €14.90; these are waived for orders over €60.
(3) Delivery is only available within Germany and Austria. Delivery is handled by DPD. Delivery to a parcel locker or self-collection is not possible. Delivery time is between 1 and 4 business days within Germany and between 5 and 7 business days within Austria. Any differing delivery times will be indicated on the respective product page.

Section 4 Payment Terms
(1) Payment can be made either via PayPal or prepayment.
(2) To pay with PayPal, the customer must be registered with PayPal. This can also be done during the ordering process mac When selecting the payment option "PayPal," the customer will be redirected to the PayPal website during the ordering process. There, they must authenticate themselves with their login details and confirm the payment instruction to the seller. After the order is completed, the seller requests PayPal to initiate the payment transaction. This is then carried out automatically by PayPal immediately thereafter. Further information is available during the ordering process.

Section 5 Retention of Title
(1) The goods remain the property of the supplier until full payment has been received.
(2) For businesses, the following applies in addition: The goods remain the property of the supplier until all claims arising from the ongoing business relationship have been paid in full. The goods subject to retention of title may be resold in the ordinary course of business. All claims arising from this resale are hereby assigned to the supplier in advance up to the amount of the invoice. The supplier accepts this assignment. The customer remains authorized to collect the receivables. The supplier may collect the receivables directly if the customer fails to meet their payment obligations.

Section 6 Right of Withdrawal
Consumers have a fourteen-day right of withdrawal. Businesses are not granted a voluntary right of withdrawal.

Cancellation policy

Right of withdrawal:
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last goods.

You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal:
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs arising from your choice of a delivery method other than our cheapest standard delivery option), without undue delay and at the latest within fourteen days from the day on which we receive your notification of withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods if this diminished value is due to handling of the goods that was not necessary for testing their condition, properties, and functionality.

Section 7 Warranty, Customer Service, Online Dispute Resolution
(1) The statutory warranty rights apply.

The European Commission provides a platform for online dispute resolution (ODR), which can be found at https://ec.europa.eu/consumers/odr/main/ . We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

Section 8 Final Provisions
(1) If the customer is an entrepreneur, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) If the customer is a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law, or a special fund under public law, Schleiden shall be the exclusive place of jurisdiction for all disputes arising from contractual relationships between the provider and the customer.
